Cole Co. judge upholds tossing out petition signatures

A Cole County judge has upheld Missouri Secretary of State Robin Carnahan's decision to toss out thousands of signatures on two eminent domain ballot petitions. Judge Richard Callahan ruled that petition circulators must be properly registered with the Secretary of State's office; otherwise, the signatures they collect cannot be counted. The decision affects around 4,300 signatures from the St. Louis area. Laura Egerdal is Communications Director for Carnahan. "You know, at this point, (the) statute is very clear that we are prohibited from accepting signatures that were collected by unregistered circulators," Egerdal said. Ron Calzone, who chairs the group Missouri Citizens for Property Rights, disagrees.

Most informed voters are aware that there are only two measures on the statewide ballot next week. Prop 98 is supported by the California Farm Bureau Federation, Howard Jarvis Taxpayers Association, National Federation of Independent Business, the California Association of Realtors and a host of other interests seeking to preserve and defend property rights in California. The other measure, Prop 99, was put on the ballot through funding almost exclusively through associations of government entities -- the lion's share from the League of California Cities. The irony in this initiative battle is that the government interests have repeatedly accused the property rights interests of having a "hidden agenda" simply by including a phase out of rent regulations along with eminent domain reform. Rather than hidden, the provisions dealing with price controls on property are prominent and appear near the very beginning of the measure. Indeed, references to these provisions are replete through the ballot pamphlet.
Affirmative Action Petition Misses Deadline

A group seeking to bar many state affirmative action programs has missed a Sunday deadline to submit its initiative petition. Missouri had been one of five states California businessman Ward Connerly and his supporters had targeted for an effort to strike down affirmative action laws. The Missouri effort was lead by Tim Asher, a former admissions director at North Central Missouri College in Trenton. Asher said it became obvious on Saturday that there were not enough signatures to qualify for the ballot, and he pledged to try again in 2010.
